Bithright Citizenship — Fox Enters False Argument to Protect Illegals

stock here: Shame on them, they are pretending that the issue is that for a baby born in the USA, that the intent of the law was to make the whole family of ancesters citizens. And that is absurd, so they conclude that for sure the baby will be a citizen, AKA an anchor baby. The use of “jurisdiction” is key IMHO. Judge that word by the last sentence….anyone physically present, if that presence made them under “Jurisdiction” then the same amendment would instantly and completely give them the “Equal protection of all of our laws” which in my view would be patently absurd. I present 4 A-Eye options for labels to give the illegals, that differentiates from “Jurisdiction”, I also proposed “Under Control”.

The exact language related to birthright citizenship in the U.S. Constitution is found in the Fourteenth Amendment, Section 1, which states:

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

Key Elements:

"Born or naturalized in the United States": Establishes that individuals born on U.S. soil or those who become citizens through the naturalization process are U.S. citizens.
"Subject to the jurisdiction thereof": This clause has been interpreted to mean that individuals born in the U.S. are citizens, except for certain exceptions like children of foreign diplomats, enemy combatants, or sovereign Native American tribes (prior to specific legislation such as the Indian Citizenship Act of 1924).
Privileges and Protections: The amendment also emphasizes that all citizens have the same legal protections and rights under federal and state laws.

This clause in the Fourteenth Amendment is the basis for the principle of jus soli (right of the soil), which grants citizenship based on birthplace. The interpretation of “subject to the jurisdiction thereof” has been central to debates over birthright citizenship in the U.S.
